Terms of Use
These terms describe the framework for using OpenMyOrganization (OMO), a free software for cooperation and governance. Accessing and using the official instance implies acceptance of these terms. They distinguish the service hosted by the project from installations operated by third-party organizations.
1. The Software and Its Instances
OMO is free software licensed under the GNU Affero General Public License, version 3 only (AGPL-3.0-only). The license text and source code are available in the project's GitHub repository. Any organization can install and operate its own instance subject to this license and applicable law. In particular, people interacting remotely with a modified version must be able to obtain the corresponding source code as provided by the AGPL. These terms describe the instance hosted by the project; they do not create a service contract between the project and people using an independent instance. The organization operating this instance sets its own terms and assumes responsibility.
2. Project-Hosted Service
Access to the official instance is offered freely, without a contractual subscription, commitment period, or guaranteed service level. The project may change, limit, interrupt, or terminate all or part of the service, particularly for maintenance, security, or project continuity. Where possible, planned interruptions or significant changes will be announced through available means.
3. Contributions and Donations
The project is funded notably by donations. Messages may invite people not identified as contributors to support the project. These invitations are informative and may be displayed regularly. A donation is voluntary: it does not constitute payment for a subscription or service, does not guarantee special access, and does not confer any control rights over development. Processing a donation made through an external platform also depends on that platform's terms.
4. Accounts and Use
Users must provide accurate information when required, protect their access means, and respect the rights of others. They must not use the service for illegal activities, harm systems, bypass access controls, or upload content they do not have the right to use. Organization administrators determine access, published content, and settings for their space; they ensure they have the necessary bases and permissions for processing the data they enter.
5. Hosting, Data, and Backups
The instance hosted by the project is hosted by Infomaniak. Backups of this infrastructure are performed according to Infomaniak's services and policies applicable to the hosting concerned. The project does not promise separate backups, frequency, or additional restoration times. Provider terms may change; information published by Infomaniak and OMO's privacy policy supplement this point.
For a self-hosted instance, the organization operating it is solely responsible for its hosting, system security, backups, verification, and data restoration. It is also responsible for accounts, access rights, compliance of processing, and informing concerned individuals. The project does not administer these instances and cannot guarantee their security or recover their data.
6. Updates and Maintenance
The project may release fixes, improvements, and security updates. An organization installing OMO from GitHub can configure automatic updates if its environment allows; this automation does not guarantee that every update will be applied or that it will proceed without intervention. The organization operating its server remains responsible for following updates, applying them in a timely manner, monitoring their outcome, and maintaining its dependencies and infrastructure. It is recommended to have verified backups and a rollback procedure.
7. Bugs and Reports
The software is subject to continuous development and maintenance but may contain errors, interruptions, or features that do not meet all needs. Anomalies can be reported in the GitHub repository's Issues section. Before publishing a report, avoid including personal data, passwords, tokens, or sensitive information. For a suspected security vulnerability, use the private reporting instructions provided by GitHub rather than a public message containing exploitable details.
8. Security and Liability Limits
The project makes reasonable efforts to secure the platform and protect the data of the instance it hosts. Risks evolve, and attempts to compromise online services increase; no measure can guarantee absolute security, permanent availability, absence of bugs, or incident-free data retention. The software is provided under the terms of its open-source license, without a general guarantee of uninterrupted operation or fitness for a particular purpose.
Within the limits allowed by applicable law, the project disclaims all liability for damages resulting notably from an interruption, bug, data loss or alteration, unauthorized access, third-party service, or use of a self-hosted instance. Nothing in these terms excludes or limits liability that cannot legally be excluded, notably in cases of fraud or gross negligence when Swiss law applies, nor the mandatory rights benefiting a user. Mandatory data protection rules remain applicable.
9. Third-Party Services and Personal Data
Some functions may depend on third-party services or transmit data to providers chosen or configured by the organization. Their use is subject to their own terms and policies. Information on data processing related to the project-hosted instance is found in the privacy policy. For an independent instance, the organization operating it determines the processing and provides the required information to its users.
10. Terms Evolution and Applicable Law
These terms may be updated when the software, its hosting, or applicable requirements change. The version published on this page applies from its publication. These terms are interpreted according to Swiss law, subject to applicable mandatory rules and protections benefiting any user under the law of their place of residence. If a provision is unenforceable, the other provisions remain effective to the extent permitted by law.
